This panel will cover legal strategies that can be deployed to explicitly raise and fight back against anti-Blackness and racial discrimination in the immigration context. Panelists will cover the many ways anti-Blackness manifests itself in the immigration system, including access to counsel issues, criminalization and pipeline to deportation, laws with racist origins and application, and racial bias in discretionary determinations such as bond, waivers, and other applications for relief. The panel will then present an overview of legal strategies that have been used or that could be deployed to address racial bias in the system, and will dive into how these strategies were used in Ousman Darboe's case.

Panelists will discuss the trends immigration lawyers are seeing in practice, what immigration attorneys can do to respond, and ways to challenge these practices when they undermine due process for your clients.
