Program Description
Much has changed in immigration removal defense practice since the start of the current administration whose goal is to prioritize immigration enforcement across every agency, including the Board of Immigration Appeals (BIA). Firings of BIA members for political reasons has established a less ideologically diverse set of Appellate Immigration Judges who have issued a litany of decisions. These decisions have expanded mandatory detention, targeted the flight risk and danger to the community bond standard, narrowed eligibility for asylum and for people with convictions, and allowed Immigration Judges to pretermit asylum cases without a hearing. Against this landscape, practitioners who lose before the Immigration Judge, must still seek redress to the very BIA that issued these negative decisions. Two BIA experts will discuss substantive and procedural trends at the BIA, common Immigration Judge errors to raise on appeal, tips on avoiding summary dismissal including how to handle shifting particular social group case law when an appeal is pending, tips on fee waiver requests, and timing expectations.
