Program Description
Immigration and Customs Enforcement (ICE) is detaining noncitizens at unprecedented levels in unheard of contexts, often unlawfully. Meanwhile, the traditional tools to fight detention—bond, stays of removal, deferred action, and bona fide determinations, to name a few—are proving futile under an administration that prioritizes everyone for detention and pressures Immigration Judges and U.S. Citizenship and Immigration Services to become just another enforcement agency. However, “The Great Writ” of habeas corpus remains an important tool to check ICE’s detention authority and abuse. This webinar will cover the fundamentals of immigration habeas corpus petitions, address traditional scenarios where habeas has been successful, and discuss potential habeas claims and strategy in the current and never before seen enforcement contexts.
