Program Description
Since the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, expedited removal orders have prevented millions of noncitizens from obtaining legal status. However, in certain circumstances, noncitizens can challenge expedited removal orders through a regulatory provision that authorizes reopening or reconsideration of immigration decisions. The faculty will discuss how to screen for expedited removal orders, review 8 CFR § 103.5, highlight potential legal and factual arguments, offer insight into the framing and components of the motion to reopen or reconsider requests, and offer general tips for pursuing these cases.
