Program Description
The Trump administration is continuing its aggressive efforts to prevent asylum seekers from getting their day in court. While pretermissions under the so-called Asylum Cooperative Agreements are currently paused, the Department of Homeland Security (DHS) continues to aggressively move to pretermit cases, claiming that the application is not complete as required by Matter of C-A-R-R-, that the application fails to state a prima facie claim as required by Matter of H-A-A-V-, and/or that any updates the asylum seeker makes restarts the clock for one year filing deadline purposes.
During this webinar, the faculty will discuss:
- Matter of C-A-R-R- and common arguments made by DHS to pretermit for “incomplete” I-589s;
- Matter of H-A-A-V- and how to frame and preserve arguments on prima facie eligibility for asylum;
- Matter of M-A-F- and how to address one year filing deadline issues after updating asylum applications;
- Matter of C-I-G-M- & L-V-S-G- and addressing so-called “asylum cooperative agreement” removals on appeal; and
- Practical tips to preserve the record in pretermission cases for potential circuit court appeal.

The North Carolina State Bar, the Ohio State Bar Association, the State Bar of Texas, and the Washington State Bar Association have approved this webinar for 1.50 CLE credits.
Uniform Certificates of Attendance will be available for attorneys to request CLE credits in other states. The National Immigration Project is also prepared to provide proof of attendance upon request. Registrants are responsible for any fees incurred in seeking CLE credit outside of North Carolina, Ohio, Texas, and Washington.
