Program Description
In 2024, the Executive Office for Immigration Review (EOIR) issued a final rule codifying the authority of immigration judges (IJ) and the Board of Immigration Appeals (BIA) to terminate and administratively close removal proceedings—including in situations where a noncitizen is pursuing immigration relief with U.S. Citizenship and Immigration Services (USCIS). Although these regulations remain binding, over the course of the last year EOIR has acted to circumvent them and make it increasingly difficult for noncitizens in removal proceedings who are seeking relief with USCIS to avoid a removal order. During this 90-minute webinar, the faculty will discuss regulations, agency decisions, and federal appeals court decisions on continuances, administrative closure, and termination for the purpose of pursuing USCIS relief. Faculty will provide attendees with practice tips for arguments in support of these motions, with an eye toward making a strong record for BIA appeal and potential federal court petition for review. During the webinar we will discuss certain relief-specific arguments including related to those pursuing Special Immigrant Juvenile Status.

CLE Credits
An application for 1.50 CLE credits is pending with the Washington State Bar Association, and the State Bar of Texas have approved this webinar for 1.50 CLE credits.
Uniform Certificates of Attendance will be available for attorneys to request CLE credits in other states. The National Immigration Project is also prepared to provide proof of attendance upon request. Registrants are responsible for any fees incurred in seeking CLE credit outside of Texas or Washington.
