Program Description
The first year of the second Trump administration has resulted in extraordinary changes to immigration law and practice already. In addition to navigating the substantive and procedural changes that govern our practice, practitioners must also consider ethical obligations at a moment in time when the legal profession generally, and immigration counsel specifically, is under attack from the executive branch. This training will discuss how practitioners can (and must) navigate the minefields that the administration has erected for immigration practitioners.
During this webinar, the faculty will discuss:

Duties of competency when the law is changing rapidly;

Lozada requirements and the ethics of ineffective assistance of counsel complaints when the law is changing rapidly;

Avoiding ethical problems when paying fees on clients’ behalf;

Digital ethics, use of artificial intelligence in legal practice and concerns over social media;

Counseling clients about options without running afoul of laws which criminalize certain forms of assistance to noncitizens.

CLE Credits
An application for 1.50 CLE ethics credits is pending with the Washington State Bar Association, and the State Bar of Texas has approved this webinar for 1.50 ethics credits.
Uniform Certificates of Attendance will be available for attorneys to request CLE credits in other states. The National Immigration Project is also prepared to provide proof of registration/attendance upon request. Registrants are responsible for any fees incurred in seeking CLE credit outside of Texas or Washington.
