Program Description
Immigration Judges (IJs) have increasingly begun to pretermit asylum applications--often ordering asylum seekers removed without ever having a chance to have a hearing on their claims. This webinar will discuss the Executive Office for Immigration Review (EOIR) Policy Memo on Pretermission as well as the Board of Immigration Appeals decision, Matter of C-A-R-R-, and how IJs have been applying these directives to pretermit cases.
During this webinar, the faculty will discuss:
- The EOIR Pretermission Memo and how it misstates and contradicts controlling law;
- Matter of C-A-R-R- and how IJs have misconstrued the holding to terminate cases;
- Constitutional, statutory, and regulatory rights that asylum seekers possess to have hearings on their protection claims;
- Steps that practitioners should take to avoid pretermission and to fight back if an IJ pretermits their case.
