Program Description:
On May 15, 2025, the BIA issued Matter of Q. Li, 29 I&N Dec. 66 (BIA 2025), which interprets the “mandatory” detention provisions of INA § 235(b) to apply to a much larger group of people than had previously been considered by most IJs to be subject to mandatory detention. In particular, the decision holds that noncitizens who were apprehended by DHS shortly after entering the United States without inspection and placed directly into full INA § 240 proceedings are ineligible for an IJ bond hearing—even if the noncitizen was initially released from detention and is years later re-detained by ICE. The decision’s reasoning also has some positive implications for certain individuals who have a basis to adjust status. This free webinar, led by two of the nation’s leading litigators on immigration detention issues, will discuss the implications of the Q. Li decision and offer strategies for practitioners defending immigrants who are impacted by the decision.
