Program Description
As border policies continually change, noncitizens apprehended at the border and released by DHS are subjected to removal proceedings across the United States. During this 90-minute webinar, faculty will discuss key legal developments impacting the implications of a noncitizen’s release in the United States by DHS at or near the border. Faculty will provide tips and strategies for zealously representing noncitizens released after a border encounter. Topics will include:
-
Implications for NTA charges, relief, and detention for individuals whom DHS releases on parole under INA 212(d)(5)
-
When and how noncitizens who lack DHS parole paperwork might argue that their release was parole as a matter of law
-
Non-military parole-in-place requests with USCIS and ICE
-
Challenging “mandatory” detention for noncitizens previously released by DHS near the border
