10:05am - 11:35am CT: The Categorical and Modified Categorical Approach

(90 minutes of instruction/1.50 CLE Credits)

Defending against almost all criminal grounds of removal requires a comprehensive understanding of the categorical (and modified) categorical approach. This session will cover the key features of the approach and its effective use in removal defense.

11:45am - 12:45pm CT: Challenging Removal Based on Crimes Involving Deceit, Dishonesty, or Fraud

(60 minutes of instruction/1.00 CLE Credit)

Clients with deceit, dishonesty, or fraud-based convictions may face a crime involving moral turpitude (CIMT) or aggravated felony charges of removability that requires specific legal analysis.This session will address how to defend against CIMT and aggravated felony fraud grounds of removal based on criminal convictions that involve elements of deceit, dishonesty, or fraud.

Lawful permanent residents (LPR) who have committed an offense listed under the criminal inadmissibility grounds may be treated as applicants for admission and placed in removal proceedings upon re-entry. This session will cover how to best represent LPR clients who are or may be at risk being placed in removal proceedings upon reentry.

Working with criminal defense attorneys is essential when representing clients with pending criminal charges or clients seeking post-conviction relief (PCR). This session will explore best practices on how to engage with criminal defense attorneys to improve outcomes for your clients in immigration court.

DUIs are some of the most prosecuted offenses in the country. This session will address the immigration consequences of DUI-type offenses and how to mitigate them. The faculty will cover inadmissibility, good moral character (GMC) assessments, discretionary decisions, and more.
